Terms of service

These Terms of Service ("Terms") govern your access to and use of the Arbynart website, Shopify storefront, products, and related services (collectively, the "Services"). In these Terms, "Arbynart," "we," "us," and "our" refer to Arbynart.

Our store is hosted by Shopify. Shopify provides the ecommerce platform used to operate our storefront, but purchases made through the Services are transactions between you and Arbynart, not Shopify.

By accessing or using the Services, or by placing an order, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy and Return & Refund Policy. If you do not agree, please do not use the Services.

1. Eligibility and Account Information

You must be the age of legal majority in your place of residence, or use the Services with any consent or supervision required by applicable law.

You agree to provide accurate, complete, and current billing, payment, contact, and shipping information. You are responsible for keeping your account credentials confidential and for activity carried out through your account. Please notify us promptly if you believe your account has been accessed without authorization.

You may not use the Services or purchase our products for an unlawful or unauthorized purpose.

2. Handcrafted Wood Sculptures

Arbynart offers handcrafted wood sculptures and decorative wood art. Each piece is made from natural materials and may be finished by hand.

Natural variations are an inherent part of wood and handcrafted production. Grain patterns, knots, mineral marks, color tone, texture, finish, and small differences in handmade detailing may vary from one piece to another. These natural and handcrafted variations are not defects and contribute to the individual character of each sculpture.

We make reasonable efforts to display products, colors, dimensions, and finishes accurately. However, colors and appearance may vary due to screen settings, photography, lighting, surrounding décor, and the natural character of the wood. Product images are illustrative and should be understood together with the product description and selected options.

We may correct or update product descriptions, specifications, pricing, availability, and other information at any time. We may also discontinue a product or limit sales by customer, region, or quantity. These changes will not affect an accepted order except where necessary to correct an obvious error, comply with law, or as otherwise agreed with you.

3. Custom Orders and Customer Materials

We offer custom options such as dimensions, colors, finishes, and design variations. Before placing a custom order, you are responsible for reviewing the selected options and confirming that the specifications are correct.

If you submit a photo, drawing, text, reference image, concept, or other material in connection with a custom request ("Customer Materials"), you represent that you own it or have all rights and permissions needed for us to use it to assess, create, fulfill, and support your order. You must not submit materials that are unlawful, infringing, defamatory, exploitative, or otherwise violate another person’s rights.

You retain the rights you hold in your original Customer Materials. You grant Arbynart and the service providers involved in fulfilling your order a limited, non-exclusive right to use those materials only as reasonably necessary to quote, create, revise, fulfill, support, and document your order; prevent fraud; resolve disputes; and comply with law. We will not publicly use identifiable customer materials for marketing without separate permission.

Custom-made or personalized items are final sale for change-of-mind returns, subject to the Return & Refund Policy and any non-excludable rights under applicable law.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order-confirmation email confirms that we received your order; it does not necessarily mean that we have accepted it.

We may verify payment, address details, product specifications, custom instructions, or suspected fraud before accepting an order. We may reject or cancel an order for a legitimate reason, including an obvious pricing or product-description error, unavailable materials, an unsupported delivery destination, inability to fulfill the requested custom specifications, suspected fraud, prohibited Customer Materials, or a legal requirement.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item, including any applicable shipping charge, to the original payment method.

We may limit or cancel orders that reasonably appear to be placed by dealers, resellers, distributors, or automated systems, unless we have agreed otherwise in writing.

5. Prices, Payment, and Promotions

Prices are shown in the currency displayed at checkout. The final price, any applicable shipping charges, taxes, and other charges collected by us will be shown before you submit payment.

You authorize us and our payment providers to charge the payment method you submit for the total amount of your order. You represent that you are authorized to use that payment method and agree to provide information reasonably needed to verify the transaction.

Promotions, discounts, and coupon codes may have separate terms, may not be combined unless expressly stated, and may be changed or withdrawn before an order is accepted. If an obvious pricing error occurs, we may contact you to confirm the correct price or cancel and refund the affected order.

6. Order Changes and Cancellations

Please contact support@arbynart.com as soon as possible if you need to change or cancel an order.

Standard, non-custom orders may be cancelled before they have shipped. Once a standard order has shipped, it cannot be cancelled and must follow the return process in our Return & Refund Policy.

Custom orders cannot be cancelled once they have entered production or once materials and production time have been committed. Any change request is subject to our written approval and may require additional payment and production time.

These terms do not limit rights that cannot be excluded under applicable law, including rights that may apply if we cannot fulfill an order or if delivery is materially delayed.

7. Shipping and Delivery

Shipping and delivery estimates are estimates only and may be affected by the product’s size, complexity, custom specifications, material availability, public holidays, customs, carrier disruptions, severe weather, and other events beyond reasonable control.

You are responsible for providing a complete and deliverable shipping address, an accurate recipient telephone number where required by the carrier, and timely responses to carrier or customs requests. Additional costs caused by an incorrect address, failed delivery, refusal, failure to collect an order, or unpaid charges that were not collected at checkout may be charged to you or deducted from an otherwise available refund, to the extent permitted by law.

Where import duties, taxes, brokerage fees, or similar destination-country charges are not expressly included or collected at checkout, they may be your responsibility. Delivery details, available destinations, and shipping terms shown at checkout form part of your order.

If a shipment is delayed beyond the timeframe promised for your order, we will provide any notice, choice, cancellation, or refund required by applicable law.

8. Returns, Refunds, and Remedies

Our voluntary return, refund, inspection, exchange, and cancellation rules are set out in our Return & Refund Policy. Standard, non-custom items may be eligible for the 30-day return program described there. Custom-made or personalized items are not eligible for change-of-mind returns unless stated otherwise in that policy or required by law.

Nothing in these Terms or our policies excludes, restricts, or modifies a guarantee, warranty, right, or remedy that cannot lawfully be excluded. In particular, handmade and natural-material variations do not excuse shipping damage, faulty workmanship, a product materially different from the ordered specifications, or a failure to meet a mandatory consumer protection right.

9. Intellectual Property

The Services and their content—including the Arbynart name, logos, product names, photographs, videos, graphics, text, layout, and designs—are owned by or licensed to Arbynart and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for personal, lawful shopping purposes. Without our prior written permission, you may not reproduce, distribute, sell, license, modify, publish, publicly display, scrape, systematically extract, create commercial derivative works from, or use our website content to train an artificial-intelligence or machine-learning system.

Unless we expressly agree otherwise in writing, purchase of a product transfers ownership of the physical item only after full payment and delivery. It does not transfer copyright, trademark, reproduction, merchandising, digital, or other intellectual-property rights in our designs or website content.

10. Feedback and Reviews

If you submit a review, comment, suggestion, or other feedback intended for publication, you grant Arbynart a non-exclusive, worldwide, royalty-free right to use, reproduce, edit for length or formatting, translate, display, and distribute it in connection with our Services and marketing, subject to applicable law.

You represent that your submission is truthful, based on genuine experience where stated, and does not violate law or another person’s rights. We may remove content that is unlawful, fraudulent, abusive, misleading, infringing, or unrelated, but we do not promise to monitor all user content. We will not materially alter the meaning of a customer review.

Customer Materials and private order communications are not treated as public feedback and will not be used publicly without separate permission.

11. Third-Party Services and Links

The Services may include payment methods, applications, carrier tools, social-media features, or links operated by third parties. We do not control independent third-party services and are not responsible for their content, availability, privacy, security, or separate transactions. Please review the relevant third party’s terms and privacy policy before using its service.

12. Accuracy and Availability of the Services

We try to keep the Services accurate and available, but we do not guarantee uninterrupted, error-free, or completely secure operation. The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping charges, transit times, or availability.

We may correct errors and update information. If a correction materially affects an accepted order, we will notify you and provide any choice or remedy required by applicable law.

13. Prohibited Uses

You may not use the Services to:

  • Violate any law, regulation, sanction, or third-party right.

  • Infringe intellectual-property, privacy, publicity, or contractual rights.

  • Submit fraudulent, false, deceptive, threatening, defamatory, discriminatory, exploitative, or unlawful content.

  • Transmit malware or interfere with the security or operation of the Services.

  • Collect personal information about others without authorization.

  • Spam, phish, impersonate another person, or misrepresent your identity or authority.

  • Bypass access controls, rate limits, robot exclusions, or security measures.

  • Copy, scrape, harvest, resell, or commercially exploit the Services or their content without written permission.

We may suspend access, reject content, or cancel an affected order when reasonably necessary to address prohibited conduct. Refunds, if any, remain subject to applicable law and our policies.

14. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the website and non-product portions of the Services are provided on an "as available" basis. We do not guarantee that the website will always be uninterrupted, secure, or free of errors.

To the fullest extent permitted by law, Arbynart will not be liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, data, goodwill, or opportunity, arising from use of the Services or an order.

To the fullest extent permitted by law, our total liability arising from a product or order will not exceed the amount you paid to Arbynart for the product giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, liability that cannot lawfully be limited, or any non-excludable consumer guarantee, right, or remedy.

15. Events Outside Reasonable Control

We are not responsible for a delay or failure caused by an event outside our reasonable control, such as a natural disaster, severe weather, epidemic, war, civil disturbance, government action, labor disruption, major carrier or network failure, customs interruption, or critical material shortage. We will take reasonable steps to reduce the effect and communicate material delays.

This section does not remove any right to cancel or obtain a refund that applicable law gives you because of a delay or non-performance.

16. Changes to These Terms

We may update these Terms to reflect changes in law, business practices, or the Services. The current version will be posted with its "Last updated" date. Changes apply prospectively unless applicable law permits otherwise. Where legally required, we will provide additional notice of material changes.
